PREAMBLE
1st These general conditions of sale are agreed between CAJU CLOTHING STORE de CÁTIA RAQUEL NUNES MARQUES, with registered office at Travessa Helena Vieira da Silva, 11 4450-429, Leça da Palmeira, tax identification number 233853472 and contact +351 915 003 999 (Call to the National fixed network) , hereinafter referred to as “CAJU“ and people who wish to make purchases through the website www.caju-store.com hereinafter referred to as “User”.
2. The parties agree that purchases made through the website www.caju-store.com will be governed exclusively by this contract to the exclusion of any conditions previously available on the website.
ARTICLE 1 – OBJECT
The purpose of these general conditions of sale is to provide and define all the information necessary for the User regarding ordering, sales, payment and service provision or delivery of purchases made on the website www.caju-store.com
These conditions regulate all the steps necessary to place the order and guarantee the follow-up of this order/service provision between the Contracting Parties.
ARTICLE 2 – ORDERING
The User places their order by completing the purchase process presented on the website www.caju-store.com, adding the product(s) or service(s) they wish to order to the shopping cart:
To send your order, the User must:
a) Register on the website www.caju-store.com, providing the information requested there.
b) Log in (providing a combination of email and password chosen by the User at the time of registration).
c) Complete the information and choose the options that are available to you throughout the order completion process (delivery and billing address, shipping method, payment method, as well as the NIF and the name that, for tax purposes, you want shown on the invoice).
The final confirmation of the order by the User is equivalent to full and complete acceptance of the prices and description of the products/services available for sale as well as these General Conditions of Sale, which will be the only ones applicable to the contract thus concluded.
CAJU will fulfill orders received online up to the limit of available stocks. If the product/service is unavailable, CAJU undertakes to inform the User as soon as possible.
The data contained in the invoice is the sole responsibility of the User. The invoice once issued cannot be reissued with changes.
Order requests are valid for 3 (three) days, unless the order is registered under a promotional campaign that defines a different deadline, and it is not possible to guarantee the provision of the service, prices, discounts, promotions and offers beyond of this period. If payment is not received by our services within the aforementioned period, the order cannot be validated. Any amount received after this date will be refunded or used for a new order.
For all orders placed, the User will receive a confirmation email;
ARTICLE 3 – PAYMENT
On the website www.caju-store.com, CAJU offers the User the following payment methods:
a) ATM Card;
b) Bank Transfer.
In the case of payment by credit card, the debit will be made to the User's card before confirming the dispatch of the goods. If some ordered products are out of stock, their value will be credited to the User's card after placing the order.
Payments that are not made at the time of purchase can be made within 48 hours, and failure to pay within the indicated period will result in immediate cancellation of the order;
In case of unavailability of the merchandise, and after notice, the User has 48 hours to choose another merchandise, using the value previously delivered, and, after the 48-hour period, and without changing the order, by the User, the balance will be refunded within 15 working days.
ARTICLE 4 – DELIVERY/AVAILABILITY AND CONSUMPTION
Orders will be delivered within 30 working DAYS after placing the order. Deliveries to mainland Portugal (up to 2kgs) are made by the company MRW.
Shipping costs may be added to your order, in accordance with the price indicated in our Shipping Policy.
Products will be made available after confirmation of payment made.
ARTICLE 5 – PRICES
Prices must be understood in Euros, with fees and taxes included, taking into account the VAT in force on the date of payment of the order.
If there is an increase in the Price of any product/service, the User will be informed immediately, and may choose to receive their order (paying the difference) or cancel it.
ARTICLE 6 – PRIVACY POLICY
Your data is processed in compliance with legislation on the protection of personal data. The same, subject to computer processing, will appear in the DND database(s) and are intended for the registration and presentation of other products and services, as well as institutional information, to be made available by them.
Its provision is optional and the right to access, rectify and cancel any data that directly concerns you, in person or in writing, directly to the address on the home page of this website is guaranteed, under the terms of the law.
ARTICLE 7 – QUALITY
CAJU does not sell second-hand items, with defects or lower quality than advertised and market standards, and as indicated in the description of the merchandise presented on the website www.caju-store.com on each product page. Product sizes are as indicated in the size table contained in the information on the website www.caju-store.com. Products sold to the User are subject to the goods compliance regime provided for in Decree-Law no. 84/2021 of 18 October.
ARTICLE 8 – EXCLUSION AND LIMITATION OF LIABILITY
CAJU does not guarantee or guarantee the operation of the website uninterruptedly, and the operation of the website may be affected due to maintenance operations, updating or loading of new products or by any other case of force majeure, and outside of CAJU, namely strikes, network failures, failures of communications services or any other services, or any other natural cause, war or riots.
Likewise, CAJU is not responsible for the failures of carriers.
Likewise, CAJU is not responsible for failures resulting from the unauthorized transfer of data by the User, or for access resulting from fraudulent obtaining of User data.
ARTICLE 9 – APPLICABLE LAW AND JURISDICTION
Portuguese law applies to all operations carried out, regardless of where the User is located, considering the contract concluded in accordance with Portuguese law and the Portuguese courts having jurisdiction for this purpose.
ARTICLE 10 – ALTERNATIVE DISPUTE RESOLUTION
Although CAJU is not a member of any alternative conflict resolution organization or office, nor has it linked itself to any of the organizations, the European Commission provides an online Alternative Conflict Resolution website, available at:

The User can contact the Porto Consumer and Arbitration Information Center at http://www.cicap.pt in order to obtain more information about alternative dispute resolution.
